Start-ups, co-operatives and the environment: regulatory news and opportunities ahead

Directorial Decree of 24 January 2022 – Amendments to dd 31 March 2021: New Marcora

With the directorial decree of 24 January 2022, the Ministry of Economic Development amended the previous directorial decree of 31 March 2021, concerning access to facilitations to promote the birth and development of small and medium-sized cooperative companies.

The changes relate to the application forms: for financing; for disbursement by stage of progress; and for subsidised financing as an advance.

The beneficiaries of the measure are production and work and social cooperative companies, as defined in Law No. 49 of 27 February 1985, which, as provided for in Art. 1 of the Ministerial Decree of 4 January 2021, are already owned by CFI.

The measure makes it possible to obtain financing for an amount not exceeding five times the value of the shareholding already held by the finance company in the cooperative company and, in any case, for an amount not exceeding a total of €2,000,000.

Re-opening of applications for Italia Startup Visa and Startup Hub

On 25 January 2022, the Ministry of Economic Development announced the re-opening of applications for Italia Startup Visa.

The programme is aimed at entrepreneurs from non-EU countries who intend to launch a new innovative startup in Italy, individually or as part of a team. The programme allows applicants to apply for a one-year entry visa for self-employment in Italy, through a simplified, fast and free digital procedure.

The possibility of submitting applications is also extended to non-EU citizens already residing in Italy, through the Startup Hub programme.

Applications can be submitted from 27 January to 17 March 2022.

Decree no. 41 of 20 January 2022 – FSC Environment Operational Plan

The Ministry of Ecological Transition published Ministerial Decree No. 41 of 20 January 2022 to define the management modalities of the Development and Cohesion Plan (FSC). The latter, together with the European Structural Funds, is the financial instrument with which the country’s economic, social and territorial development objectives are pursued.

The decree repeals and replaces the previous Ministerial Decree No. 86 of 30 April 2020 and establishes that the authority responsible for the Psc is the General Administration, Planning and Natural Heritage Department (Diag). In addition, it defines the organisational structure for the management and implementation of the Psc, which is composed as follows: Monitoring Committee; Responsible Authority for the Psc; Heads of intervention sectors; Certifying Body; Control Unit.
